These Terms and Conditions (“Terms”) govern your access to and use of our website (https://youngbreeze.com.au/), our services as an NDIS provider, and any related interactions with us. By accessing our website or engaging our services, you agree to be bound by these Terms, our Privacy Policy, and applicable laws, including the National Disability Insurance Scheme Act 2013 (“NDIS Act”) and the NDIS Code of Conduct.

3. Our Services
Young Breeze provides NDIS-registered support services to help clients achieve their goals and live independently. Our services are delivered in accordance with NDIS Practice Standards, the NDIS Code of Conduct, and individual service agreements.
Service Agreements
Before providing services, we will enter into a written Service Agreement with the client or their representative, outlining the scope, cost, duration, and terms of service delivery.
Services are subject to the availability of NDIS funding in your plan and compliance with NDIA guidelines.
We reserve the right to refuse or discontinue services if they are outside our expertise, unsafe, or inconsistent with NDIS requirements.
Client Responsibilities
You agree to:
- Provide accurate and complete information about your NDIS plan, support needs, and personal circumstances.
- Comply with the terms of your Service Agreement, including payment obligations (if applicable).
- Treat our staff, contractors, and other clients with respect, in line with the NDIS Code of Conduct.
- Notify us promptly of any changes to your NDIS plan, contact details, or support needs.
- Adhere to safety and health guidelines during service delivery (e.g., safe access to your home).
4. Website Use
Access and Availability
- Our website is provided for informational purposes and to facilitate enquiries about our services.
- We do not guarantee uninterrupted access to the website. Access may be suspended or restricted for maintenance, technical issues, or other reasons without notice.
- You must not use the website for unlawful purposes, including hacking, distributing malware, or violating intellectual property rights.

- Additional Costs: Any out-of-pocket expenses (e.g., travel costs, as per NDIS guidelines) will be agreed upon in the Service Agreement.
- Payment Terms: For self-managed clients, payment is due within 7 days of receiving an invoice. Late payments may incur reasonable administration fees, subject to NDIA approval.
- Cancellations: If you cancel a scheduled service with less than 24 hours notice, cancellation fees may apply as per NDIS guidelines and your Service Agreement.
6. Termination of Services
We may suspend or terminate services if:
- You breach these Terms or your Service Agreement.
- Your NDIS funding is insufficient or withdrawn.
- Continuing services poses a risk to health, safety, or wellbeing (ours or yours).
- You engage in behaviour that violates the NDIS Code of Conduct (e.g., harassment, abuse).
Termination will be communicated in writing, with reasonable notice where possible, and in accordance with NDIS requirements. You may terminate services by providing written notice as per your Service Agreement.
7. Liability and Disclaimers
- Service Delivery: We strive to deliver high-quality services in line with NDIS standards. However, we are not liable for outcomes beyond our reasonable control, such as changes to your NDIS plan or external factors affecting service delivery.
- Website Content: Information on our website is provided in good faith but without warranty of accuracy or completeness. We are not liable for any loss or damage arising from reliance on website content.
- Limitation of Liability: To the extent permitted by law, Young Breeze excludes liability for indirect, consequential, or incidental damages arising from your use of our website or services. Our liability is limited to resupplying the service or paying the cost of resupply, as per the Australian Consumer Law.
- Force Majeure: We are not liable for delays or failures to perform due to events beyond our control (e.g., natural disasters, government restrictions).
